Alleged offence: Use of a mobile phone while driving

Dear Sir/Madam,

I am writing to formally object to the above infringement notice issued under
the Road Traffic Code 2000 (WA) reg 264. I respectfully request that the
infringement be withdrawn for the reasons set out below.

I did not commit the alleged offence. At the time the camera image was captured
I was not using a mobile phone. The object visible in my hand was my leather
wallet, which I had picked up from the centre console. I ask that the camera
image relied upon be re-examined with this in mind.

The photographic evidence is not capable of establishing the offence to the
required standard. On close inspection the object in my hand is matte and
non-reflective, shows no illuminated screen, and is broader and squarer than a
mobile telephone — characteristics consistent with a wallet rather than a phone.
The image is also affected by windscreen glare and a steep capture angle, both of
which further reduce the certainty of any identification.

Where the evidence is equally consistent with an innocent explanation, the
alleged offence cannot be made out. I did not at any point hold, touch, operate
or rest a mobile phone in a manner prohibited by reg 264, and the notice should
not stand on the strength of an ambiguous image.

I take road safety seriously and have a clean recent driving record. I therefore
ask that you withdraw this infringement. In the alternative, I request that the
matter be dealt with by way of a formal caution.
